Pops v. Commonwealth

Facts:

Defendant argued that the Henrico County court erred in finding that the sex crimes charge of aggravated sexual battery did not violate the Double Jeopardy Clause of the Constitution and erred in convicting him of the same because the Commonwealth’s evidence was insufficient to prove that the touching supporting the conviction was not incidental to the forcible sodomy. But, after providing written argument to the court, which conceded that if the trial court believed the victim’s testimony, the evidence was sufficient to convict him of aggravated sexual battery, and did not address a lesser-included offense argument previously raised, the trial court found defendant guilty of aggravated sexual battery, without further explanation. As such, no double jeopardy ruling existed for the court to review on appeal.

  •   The ends of justice exception to Va. Sup. Ct. R. 5A:18 is narrow and is to be used sparingly. In order to avail oneself of the exception, an appellant must affirmatively show that a miscarriage of justice has occurred, not that a miscarriage might have occurred. Such a showing requires proof of an error that was clear, substantial, and material. In examining a case for miscarriage of justice, the Court of Appeals of Virginia does not simply review the sufficiency of the evidence under the usual standard but instead determines whether the record contains affirmative evidence of innocence or lack of a criminal offense.
