Elvis v. Commonwealth

Facts:

Defendant sought review of the trial court’s judgment convicting him of embezzlement for applying the proceeds of two notes to the payment of both personal and corporation obligations. Defendant contended that the trial court lacked jurisdiction because the alleged embezzlement took place in Henrico County and that the trial court erred in admitting prosecution evidence of other transactions by him in an attempt to show defendant’s intent in regard to the notes. The court on appeal reversed the trial court’s judgment, concluding that the evidence regarding defendant’s prior unrelated business transactions was immaterial and irrelevant and should not have been admitted because it related to transactions that were not of a like character, did not explain the intent, purpose, and plan of defendant specifically regarding the subject notes, served only to mislead and prejudice the jury against defendant, and was not admissible under the similar acts doctrine.

  •   In cases of embezzlement and other offenses of which intent or guilty knowledge is a necessary ingredient, it is permissible to prove other acts and declarations of an accused, provided such acts and declarations are of a similar character and tend to show such intent or knowledge. Evidence is always admissible of other transactions of a like character, although they may amount to distinct felonies. Whenever the intent or guilty knowledge of a party is a material ingredient in a case, other acts and declarations of a similar character tending to establish such intent or knowledge are proper evidence.
