Amber v. Commonwealth

Facts:

Defendants hosted a party for their 16-year-old child at which alcoholic beverages were served in Henrico. A police officer responded to a call reporting underage drinking and observed, after driving up the residence driveway, young people in the backyard with beer bottles in their hands.  Defendants, convicted of contributing to the delinquency of minors, sought review of a decision from the Court of Appeals of Virginia, which affirmed a trial court decision denying their motions to suppress evidence obtained through a warrantless search of the driveway and backyard of their private residence during a party they hosted for their 16-year-old child.

  • A resident of a dwelling impliedly consents to a police officer entering the curtilage to contact the dwelling’s residents. This implied consent has the effect of deeming such an entry into the curtilage a reasonable intrusion into an area otherwise protected by an expectation of privacy under the Fourth Amendment. Implied consent can be negated by obvious indicia of restricted access, such as posted no trespassing signs, gates, or other means that deny access to uninvited persons.
